Who we are
AUN — operating under the name Ace Up Next — is a sports-matching platform headquartered in Germany. Our service connects players who need a last-minute replacement for a sports game with players who are available and willing to step in.
References to "AUN", "we", "us" or "our" refer to the operating entity behind aunweplay.com. References to "you" or "user" refer to any person who accesses or uses the platform in any capacity.

Scope & acceptance
These Terms of Use ("Terms") govern your access to and use of the AUN platform, including the website at aunweplay.com, any associated mobile applications, APIs, and all related services (collectively, the "Platform").
By using the Platform — including submitting an early access registration — you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not use the Platform.
Age requirement
You must be at least 16 years old to register and use the Platform. We do not knowingly collect data from children under 16.
Business users
If you register as a club, venue, or organiser acting in a commercial capacity, you represent that you have authority to bind that organisation to these Terms.

Early access & waitlist
AUN is currently in a pre-launch phase. By submitting your details via the early access form, you are registering your interest and confirming eligibility for early access benefits. This does not yet constitute a service agreement — it is a pre-registration.
The early access promise
The first 1,000 people who register in good faith will receive the following benefits once the Platform launches:
- Permanent priority matching — your replacement or join requests will be surfaced ahead of standard users, for life.
- Free access for life — your core account will remain free even after premium tiers are introduced. Premium add-ons are not included.
- Direct roadmap input — early access users will have a dedicated channel to submit and vote on product features.
- Beta access — you will be among the first to access new features before general release.
Important
These benefits are personal and non-transferable. They are attached to the registered email address and cannot be sold, gifted, or assigned. They remain in effect as long as your account is active and in good standing.
What "free for life" means
Core matching functionality — submitting and receiving replacement requests, joining available games, and basic profile management — will remain free for early access users permanently. Features introduced after launch as explicitly premium may be offered on a paid basis.

Accounts
When the Platform launches, you will be required to create an account to access core functionality. You agree to provide accurate, complete, and up-to-date information when registering and to keep it current.
Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at Get in touch →.
One account per person
Each user may maintain one personal account. Creating multiple accounts to circumvent a suspension or accumulate early access benefits is prohibited.

Conduct rules
AUN is built on trust between players. Violating these rules will result in warnings, suspension, or permanent removal from the Platform.
You must not
- No-shows without notice. If you commit to a game and cannot attend, notify the organiser as early as possible. Repeated unexplained no-shows will result in account restrictions.
- Spam or unsolicited contact. Using AUN's messaging tools for promotional purposes or bulk messaging is strictly prohibited.
- False profiles. Misrepresenting your identity, skill level, or location is prohibited.
- Harassment or abuse. Any form of harassment, discrimination, or abusive behaviour will result in immediate suspension.
- Scraping or automated access. Using bots or scrapers to access the Platform without express written permission is prohibited.
- Illegal activity. Using the Platform to facilitate or engage in any activity that violates applicable law.

User content
The Platform may allow users to submit content including profile information, game descriptions, ratings, reviews, photos, and messages ("User Content"). You retain ownership of any content you submit.
Licence to AUN
By submitting User Content, you grant AUN a non-exclusive, royalty-free, worldwide, sublicensable licence to use, store, display, reproduce, and distribute that content solely for the purposes of operating and improving the Platform.
Your responsibilities
- You own or have the right to use all content you submit.
- Your content does not infringe the intellectual property or privacy rights of any third party.
- Your content is accurate and not misleading.
- Your content does not contain defamatory, obscene, offensive, or illegal material.

Clubs & organisers
Clubs and game organisers using AUN to manage or fill their events are subject to these Terms in addition to any separate club agreement entered into with AUN.
Accuracy of listings
Clubs and organisers are responsible for the accuracy of all game and venue information they publish, including location, time, sport type, skill level, and any fees.
AUN's role
AUN acts solely as an introduction platform between clubs/organisers and players. We are not a party to any agreement between a club and a player, and bear no liability for what occurs at games arranged through the Platform.

Payments & premium features
AUN is currently free to use. At some point after launch, we intend to introduce optional premium features.
Advance notice commitment
We will give all existing users at least 30 days' written notice (by email) before any previously free feature becomes paid. Early access users will never be charged for core matching functionality as described in Section 3.
Right of withdrawal (Widerrufsrecht)
If you are a consumer resident in the EU, you have the right to withdraw from a digital services contract within 14 days of purchase without giving any reason, in accordance with the EU Consumer Rights Directive and § 355 BGB.

Liability
Limitation of liability
To the maximum extent permitted by applicable law, AUN's total liability to you for any claim shall not exceed the greater of: (a) the total amount you have paid to AUN in the 12 months preceding the claim, or (b) €100.
AUN is not liable for:
- Any injury, illness, accident, or damage occurring at a game arranged through the Platform.
- The conduct, reliability, or skill level of any user you are matched with.
- A failure to find a replacement player for any given game.
- Loss of data, loss of profits, or any indirect, special, or consequential loss.
Statutory rights
Nothing in these Terms limits AUN's liability for death or personal injury caused by AUN's negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under German law.

Intellectual property
All rights in the AUN brand, logo, Platform design, software, content, and underlying technology are owned by or licensed to AUN and are protected under German and international intellectual property law.
You may not copy, reproduce, reverse-engineer, or use AUN's name or branding in any way without prior written consent.

Termination
By you
You may close your account at any time by contacting us at Get in touch →. Early access benefits are non-refundable and will be forfeited upon account closure.
By AUN
We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms or that your continued use poses a risk to other users or the Platform.

Changes to these terms
AUN may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect.
The current version of these Terms is always available at aunweplay.com/terms.html, with the effective date noted at the top.

Governing law & disputes
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions.
